1. The Service

These Terms of Service ("Terms") govern your use of KO ("Service"), a marketing and revenue intelligence platform operated by KO Data Oy ("we", "us", "our").

KO connects advertising platforms (Meta, Google Ads, LinkedIn, TikTok), CRM systems (HubSpot, Pipedrive, and others), and analytics tools (Google Analytics 4 and others) to help you understand which marketing activities drive real business outcomes.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Accounts

To use KO, you must create an account. You are responsible for:

Keeping your login credentials secure
Ensuring all information you provide is accurate and up to date
All activity that occurs under your account

If you believe your account has been compromised, notify us immediately at hello@kodata.pro.

You must be at least 18 years old and authorized to act on behalf of the organization you register. Company accounts are managed by the individual who creates them — that person accepts these Terms on the organization's behalf.

3. Acceptable Use

You agree to use KO only for lawful business purposes. You must not:

Attempt to gain unauthorized access to KO's systems or another user's account
Reverse engineer, decompile, or copy any part of the Service
Introduce malicious code, scripts, or bots
Use the Service to process data you are not authorized to handle
Resell or sublicense access to KO without our written consent

We may suspend or terminate access immediately if we detect a violation.

4. Data & Integrations

KO processes data from third-party platforms you connect, including advertising networks, CRM systems, and analytics tools. You are responsible for having the necessary rights and permissions to connect these platforms and share their data with KO.

You retain full ownership of your data. We process it solely to provide the Service as described in our Privacy Policy and Data Processing Agreement.

All data is stored and processed on our self-hosted infrastructure, primarily hosted on Hetzner servers located in the EU. We do not use third-party SaaS data warehouses to store your business data.

KO does not sell your data or use it to train AI models for third parties. With your explicit consent — provided via the AI feature opt-in when you first activate AI functionality in the platform — your data may be used to improve KO's own AI-powered features. You can withdraw this consent at any time from your account settings.

5. Billing & Payments

KO operates on a subscription model. Plans are billed monthly or annually in euros (€), depending on the option you select at signup.

Payments are processed at the start of each billing period
Prices are displayed exclusive of local taxes where applicable
We reserve the right to update pricing with at least 30 days' notice
You will be notified of any price changes before they take effect

By default, subscriptions renew automatically unless cancelled before the next billing date.

6. Cancellations & Refunds

You can cancel your subscription at any time from your account settings.

Access continues until the end of the current billing period
We do not issue partial refunds for unused time
Refunds are provided only where required by applicable law

After cancellation, your data is retained for 30 days and then permanently deleted unless you request earlier deletion.

7. Service Availability

We work to keep KO available and reliable. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, infrastructure updates, or circumstances outside our control.

We may modify, deprecate, or update features at any time. For significant changes, we will notify users in advance where reasonable.

8. No Guarantees on Outcomes

KO provides data analytics and attribution tooling. We do not guarantee specific business outcomes, revenue increases, or marketing performance improvements.

The accuracy of insights depends in part on the quality and completeness of data from third-party integrations. We are not responsible for inaccuracies or delays originating from external APIs or platforms.

9. Limitation of Liability

To the maximum extent permitted by law, KO Data Oy is not liable for:

Indirect, incidental, or consequential damages
Lost profits, revenue, or business opportunities
Data loss resulting from third-party platform changes or API failures
Decisions made based on insights provided by the Service

Our total liability in any case is limited to the amount you have paid us in the three months preceding the claim.

10. Suspension & Termination

We may suspend or terminate your account if:

You violate these Terms
We detect fraudulent activity or abuse
Payment is overdue by more than 14 days

In cases of serious violations, suspension may be immediate and without prior notice. We will make reasonable efforts to communicate the reason.

11. Intellectual Property

KO, its interfaces, algorithms, and underlying software are the intellectual property of KO Data Oy. Nothing in these Terms grants you ownership of any KO technology or brand assets.

You retain all rights to your own data and any content you create using the Service.

12. Governing Law

These Terms are governed by Finnish law. Any disputes shall be resolved in the courts of Finland, unless otherwise required by applicable consumer protection law.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page and notify active users by email for material changes.

Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
